LACY SERVICES, LTD. v. ALBERTIA CARLILE, CHARLES E. ELLIS, CHARLES LEE LAMPLEY, JR., DONNIE HUMPHRIES AND THEIR UNKNOWN HEIRS, SUCCESSORS OR ASSIGNS. A brief statement of the nature of this suit is as follows, to wit: Plaintiff is seeking Appointment of a Receiver to execute oil, gas and mineral lease, assignment, memorandum of oil and gas lease or other necessary documents relating to the undivided mineral and leasehold interest for the following tracts of land: TRACT ONE 1.0 acre of land, more or less, a part of the Ira M. Freeman Survey, A-204, Panola County, Texas, and being the same land described in that certain Warranty Deed dated January 15, 1965, from Lamar Fowler and wife, Ophelia Fowler and Carl Green and wife, Lavada Green to Philip Wayne Rodgers recorded in Volume 476, Page 99, of the Deed Records of Panola County. (Tr. 204-11) TRACT TWO 37.5 acres of land, more or less, a part of the Ira Freeman Survey, A-204, and E. Williams Survey, A-729, and being 39.5 acres described as 1st Tract of 13 acres, 2nd Tract of 23 acres, and 3rd Tract of 3.5 acres in a Warranty Deed dated January 26, 1917 from Edgar Kelley to Mollie Kelley, recorded in Volume 50, Page 380 of the Deed Records of Panola County, Texas, SAVE AND EXCEPT 2.0 acres, more or less, a part of the E. Williams Survey, A-729, being described in a Warranty Deed dated July 10, 1967 from Troy B. McRae and wife, Lafayette McRae to A. L. Downs and wife, Nettie Downs, recorded in Volume 501, Page 8 of the Deed Records of Panola County, Texas, and leaving 37.5 acres herein. (Tr. 204-12) TRACT THREE 18.5 acres of land, more or less, a part of the Ira Freeman Survey, A-204, Panola County, Texas, and being all of that certain 39 acres of land described in Warranty Deed dated January 26, 1917, from Edgar Kelley to W.H. Kelley recorded in Volume 51, Page 250, of the Deed Records of Panola County that is found to be lying within the boundaries of a 51 acres tract of land, more or less, described in that certain Warranty Deed dated June 3, 1957, from Minnie Rodgers to Marcus Rodgers recorded in Volume 405, Page, 403; LESS AND EXCEPT: 1 acre of land, more or less, a part of the Ira M. Nelson et ux, Patsy Ruth Allen Nelson, dated May 15, 1954, recorded in Volume 355, Page 621, Deed Records, Panola County, Texas, and LESS AND EXCEPT 10.9 acres of land, more or less, being more fully described in that certain Warranty Deed from Emma Williams and husband, Fred Williams, to Jimmie Allen and James L. Allen, dated September 24, 1962, recorded in Volume 453, Page 345, Deed Records, Panola County, Texas, LEAVING HEREIN APPROXIMATELY 26.85 acres of land, more or less. Koher Survey, A-378, Panola County, Texas, and being all of that certain 10.9 acre tract of land described in that certain Warranty Deed dated September 24, 1962, from Emma Williams and husband, Fred Williams to Jimmie Allen and James L. Allen recorded in Volume 453, Page 345, of the Deed Records of Panola County, Texas located within the Elias M. Koher Survey, A-378.
