Said Plaintiffs Original Petition was filed in said court on the 11th day of June 2025 in the above entitled cause. A brief statement of the nature of this suit is as follows, to-wit: Plaintiff seeks a declaratory judgment that (1) Plaintiff has a valid superior lien created under Tex. Const. art XVI 50(a)(6) against the Property; (2) includes an order authorizing plaintiff to foreclose its lien in compliance with the Loan Agreement and Tex. Prop. Code 51.002; (3) Plaintiff is authorized to enforce the home equity security agreement against the Property; (4) all the heirs-at-law of the deceased borrower have been made parties to this suit; and (5) upon foreclosure divest the Mortgagors, Decedent’s putative estate and Decedent’s heirs of all right, title, and interest in the Property. All that certain 0.729 acre tract of land, a part of the John Parmer Survey, Abstract No. 899, also a part of the A.T. Nicholson Survey, Abstract No. 518, Panola County, Texas, and being a part of the remainder that certain tract of land called one acre described in a deed from Ronald M. Clark and wife, Guyla S. Clark to Virgil D. Calvert and Glennis Calvert dated April 2, 1987, recorded in Volume 808, Page 51 of the Deed Records of Panola County, Texas, and also being a small portion of that certain tract of land called 1.4 acres described in a deed from J.P. Briggs and Willie Kate Briggs to Virgil D. Calvert and Glennis Calvert dated April 13, 1982 recorded in Volume 717, Page 169 of the said Deed Records and the said 0.729 acre subtract tract.
