OFF LEASE PENETRATION POINT NOTICE NOTICE IS HEREBY GIVEN that AGIS Energy LLC (“AGIS”) [Operator No. 103297] will file an amended drilling permit with the Railroad Commission of Texas on the Werner-White Lease, Well No. 2H (API No. 42-365-38743) in the Carthage (Cotton Valley) Field, Panola County, Texas. The well is drilled from a surface location on the AGIS lease, pooled unit or unitized tract for which the well is permitted. The penetration point for the well will be on a location outside the AGIS lease, pooled unit, or unitized tract (“Offsite Tract”). The Offsite Tract is located on the JM Dollahite Survey, A-173, Panola County, Texas. Pursuant to the Final Order Amending Field Rules for the Carthage (Cotton Valley) Field, Docket No. 06-0268520, Rule 2, AGIS is required to provide notice of the penetration point to the designated operator, lessee of record, and unleased mineral owner under the Offsite Tract. PURSUANT TO THE TERMS of Railroad Commission rules and regulations, this application may be granted WITHOUT A HEARING if no protest to the application is received within 28 days of the deadline of this notice. An affected person is entitled to protest this application. If any affected person of the Offsite Tract objects to the location of the penetration point, the applicant may request a hearing to demonstrate the necessity of the location of the penetration point of the well to prevent waste or protect correlative rights.
