TEXAS COMMISSION ON ENVIRONMENTAL QUALITY NOTICE OF RECEIPT OF APPLICATION AND INTENT TO OBTAIN WATER QUALITY PERMIT RENEWAL PERMIT NO. WQ0002644000 APPLICATION. Luminant Mining Company LLC, 6555 Sierra Drive, Irving, Texas 75039, which operates a lignite mining facility, has applied to the Texas Commission on Environmental Quality (TCEQ) to renew Texas Pollutant Discharge Elimination System (TPDES) Permit No. WQ0002644000 (EPA I.D. No. TX0091120) to authorize the discharge of mine water, groundwater seepage, and surface water runoff from the Oak Hill active mining areas via Outfalls 001M – 007M, 013M – 019M, 024M – 030M, 033M – 035M, 037M - 038M, 040M – 042M, and 045M – 047M on an intermittent and flow-variable basis; mine water, groundwater seepage, treated and previously monitored domestic wastewater from Outfall 400, and surface water runoff from the Martin Lake active mining areas via Outfall 048M on an intermittent and flow-variable basis; mine water, groundwater seepage, and surface water runoff from the Martin Lake active mining areas via Outfalls 049M, 051M – 060M, 062M – 077M, 084M, and 087M – 097M on an intermittent and flow-variable basis; mine water, groundwater seepage, wastewater from the coal combustion ash disposal sites associated with Martin Lake Steam Electric Station, ash disposal area leachate, and surface water runoff from the Martin Lake active mining areas via Outfalls 050M and 085M on an intermittent and flow-variable basis; mine water, groundwater seepage, and surface water runoff from the Liberty Auxiliary active mining areas via Outfalls 099M – 105M on an intermittent and flow-variable basis; and surface water runoff from the Oak Hill, Martin Lake, and Liberty Auxiliary post-mining areas via Outfalls 001R – 007R, 013R – 019R, 024R –030R, 033R – 035R, 037R, 038R, 040R - 042R, 045R – 060R, 062R – 077R, 084R, 085R, 087R – 097R, and 099R - 105R on an intermittent and flow-variable basis. The Martin Lake Lignite Mining Area is located two miles west of the intersection of County Road 257 and Farm-to-Market Road 124, in Panola County and Rusk County, Texas 75631; the Oak Hill Lignite Mining Area is located 0.7 mile north of the intersection of Farm-to-Market Road 1716 and State Highway 43, in Rusk County, Texas 75652; and the Liberty Auxiliary Lignite Mining Area is located 0.7 mile south of the intersection of County Road 2138 and State Highway 43, in Rusk County, Texas 75691. The discharge route is via Outfalls 001M/R – 002M/R, and 004M/R to Dry Creek, thence to Martin Lake, thence to Martin Creek; via Outfall 003M/R, and 005M/R – 006M/R to Prospect Branch, thence to Dry Creek, thence to Martin Lake, thence to Martin Creek; via Outfall 007M/R to Wasson Branch, thence to Martin Creek; via Outfalls 048M/R – 050M/R to Caney Creek, thence to Irons Bayou; via Outfall 071M/R to an unnamed tributary, thence to Caney Creek, thence to Irons Bayou; via Outfalls 051M/R and 074M/R to Murray Branch, thence to Waldrop Branch, thence to Buckner Creek, thence to Irons Bayou; via Outfall 052M/R to Waldrop Branch, thence to Buckner Creek, thence to Irons Bayou; via Outfalls 053M/R – 056M/R to Buckner Creek, thence to Irons Bayou; via Outfalls 057M/R – 060M/R, 063M/R – 064M/R, 076M/R – 077M/R, and 091M/R to unnamed tributaries, thence to Martin Creek; via Outfalls 085M/R, 087M/R – 090M/R, 092M/R – 097M/R, and 099M/R – 105M/R to Martin Lake; via Outfalls 065M/R – 066M/R to an unnamed tributary, thence to Adler Branch, thence to Martin Creek; via Outfall 062M/R to Hogan Creek, thence to Martin Creek; via Outfall 067M/R to Caney Branch, thence to Adler Branch, thence to Martin Creek; via Outfalls 068M/R and 070M/R to Elijah Branch; via Outfall 069M/R to Watson Branch; via Outfalls 084M/R to Clark Branch, thence to Martin Creek; via Outfall 072M/R to an unnamed tributary, thence to Conner Branch, thence to Irons Bayou; via Outfall 073M/R to Conner Branch, thence to Irons Bayou; via Outfall 075M/R to Mulberry Creek, thence to Martin Creek, thence all flow to the Sabine River Above Toledo Bend. Effluent is and will be discharged also via Outfalls 013M/R – 019M/R, 024M/R – 028M/R, 034M/R – 035M/R, 040M/R – 042M/R, and 045M/R – 047M/R to Mill Creek; via Outfalls 029M/R – 030M/R, and 037M/R – 038M/R to Tiawichi Creek; via Outfall 033M/R to Boggy Creek; thence to Mill Creek; thence all flow to Lake Cherokee. TCEQ received this application on May 7, 2026. The permit application will be available for viewing and copying at Rusk County Clerk’s Office, 115 North Main Street, Suite 206, Henderson, in Rusk County, Texas and at Panola County Clerk’s Office, 110 South Sycamore Street, Room 201, Carthage, in Panola County, Texas prior to the date this notice is published in the newspaper. TCEQ’s Executive Director has determined the application is administratively complete and will conduct a technical review of the application. After technical review of the application is complete, the Executive Director may prepare a draft permit and will issue a preliminary decision on the application. Notice of the Application and Preliminary Decision will be published and mailed to those who are on the county-wide mailing list and to those who are on the mailing list for this application. That notice will contain the deadline for submitting public comments. PUBLIC COMMENT / PUBLIC MEETING. You may submit public comments or request a public meeting on this application. The purpose of a public meeting is to provide the opportunity to submit comments or to ask questions about the application. TCEQ will hold a public meeting if the Executive Director determines that there is a significant degree of public interest in the application or if requested by a local legislator. A public meeting is not a contested case hearing. OPPORTUNITY FOR A CONTESTED CASE HEARING. After the deadline for submitting public comments, the Executive Director will consider all timely comments and prepare a response to all relevant and material, or significant public comments. Unless the application is directly referred for a contested case hearing, the response to comments, and the Executive Director’s decision on the application, will be mailed to everyone who submitted public comments and to those persons who are on the mailing list for this application. If comments are received, the mailing will also provide instructions for requesting reconsideration of the Executive Director’s decision and for requesting a contested case hearing. A contested case hearing is a legal proceeding similar to a civil trial in state district court. TO REQUEST A CONTESTED CASE HEARING, YOU MUST INCLUDE THE FOLLOWING ITEMS IN YOUR REQUEST: your name, address, phone number; applicant’s name and proposed permit number; the location and distance of your property/activities relative to the proposed facility; a specific description of how you would be adversely affected by the facility in a way not common to the general public; a list of all disputed issues of fact that you submit during the comment period and, the statement “[I/we] request a contested case hearing.” If the request for contested case hearing is filed on behalf of a group or association, the request must designate the group’s representative for receiving future correspondence; identify by name and physical address an individual member of the group who would be adversely affected by the proposed facility or activity; provide the information discussed above regarding the affected member’s location and distance from the facility or activity; explain how and why the member would be affected; and explain how the interests the group seeks to protect are relevant to the group’s purpose. Following the close of all applicable comment and request periods, the Executive Director will forward the application and any requests for reconsideration or for a contested case hearing to the TCEQ Commissioners for their consideration at a scheduled Commission meeting. The Commission may only grant a request for a contested case hearing on issues the requestor submitted in their timely comments that were not subsequently withdrawn. If a hearing is granted, the subject of a hearing will be limited to disputed issues of fact or mixed questions of fact and law relating to relevant and material water quality concerns submitted during the comment period. TCEQ may act on an application to renew a permit for discharge of wastewater without providing an opportunity for a contested case hearing if certain criteria are met. MAILING LIST. If you submit public comments, a request for a contested case hearing or a reconsideration of the Executive Director’s decision, you will be added to the mailing list for this specific application to receive future public notices mailed by the Office of the Chief Clerk. In addition, you may request to be placed on: (1) the permanent mailing list for a specific applicant name and permit number; and/or (2) the mailing list for a specific county. If you wish to be placed on the permanent and/or the county mailing list, clearly specify which list(s) and send your request to TCEQ Office of the Chief Clerk at the address below.
