At approximately 3:36 p.m. on March 24, 2024, Plaintiff was traveling in a 2024 Honda Civic, westbound on Woodlawn Street, approaching the intersection with Broadway Boulevard, in Kilgore, Texas. Defendant, JONATHAN AARON MORALES, was operating a 2008 Honda Accord owned and/or leased by Defendant, JEMIMA KEREN TEZCUCANO, northbound on Broadway Boulevard, approaching a stop sign located at the intersection with Woodlawn Street, in Kilgore, Texas. As Plaintiff was traveling through the intersection, suddenly and without warning, Defendant, JONATHAN AARON MORALES, after having initially stopped at the stop sign located at the intersection, failed to yield the right-of-way to Plaintiff’s vehicle, totally disregarded the stop sign located at the intersection, and entered the intersection and into Plaintiff’s path, colliding with Plaintiff’s vehicle and subjecting Plaintiff to tremendous force.
