The sale is scheduled to take place if approved by the Commission (Texas Water Code § 13.301). The transaction and the transfer of the CCN includes the following: The requested area is located approximately 6.8 miles northeast of downtown Hallsville, Texas, and is generally bounded on the north by Airlite Road; on the east by the intersection of State Highway 154 and Haynes Road; on the south by Farm to Market Road 449; and on the west by Airlite Road. The requested area includes 106 customer connections and approximately 568.6 acres, comprised of: 508.5 acres to transfer from CCN No. 12819 to CCN No. 13290; and 21.8 acres of uncertificated area to amend (add) to CCN No. 13290; and 38.3 acres to obtain dual certification with a portion of Talley WSC (CCN No. 10414) and CCN No. 13290. The application proposes the subtraction of approximately 508.5 acres from CCN No. 12819 and the addition of approximately 568.6 acres to CCN No. 13290. 530.3 acres will be single certification with CCN No. 13290. 38.3 acres will be dual certification between CCN No. 10414 and CCN No. 13290. All landowner opt-out requests must include the commission docket number, CCN number, the total acreage to remove from the requested area, a sealed or embossed metes and bounds description or survey of the landowner’s tract of land, and the landowner’s name, address, email address and fax number, if applicable. A landowner that opts out from the requested area releases the applicant’s obligation to provide retail water utility service to the removed land for any reason.
