A brief statement of the nature of this suit is as follows, to-wit: CROSS-PLAINTIFF’S ORIGINAL CROSSCLAIMS AND PLAINTIFF’S ORIGINAL PETITION, INJURY/DAMAGE-MOTOR VEHICLE. 25-0952 At approximately 5:30 p.m. on November 14, 2023, Cross-Plaintiff and Plaintiff. JAMES JOHNNY CRAVER (“Cross-Plaintiff/Plaintiff” or “CRAVER”) was traveling in a 2012 Dodge Ram 2500 pickup truck, eastbound on Interstate Highway 20, in the inside lane, stopped for heavy traffic behind Kadee Wilkins Clark, in Harrison County, Texas. Kadee Wilkins Clark was traveling in a 2020 Ford F150 pickup truck, eastbound on Interstate Highway 20, in the inside lane, traveling just ahead of Cross-Plaintiff/Plaintiff CRAVER, in Harrison County, Texas. Cross-Defendant VIDAL CABRERA ARNALDO, and/or Defendant, ARNALDO VIDAL CABRERA, was driving a 2022 Volvo tractor owned and/or leased by Cross-Defendant, STAR TRANSPORTATION PA INC, and/or Defendants, STAR TRANSPORTATION, LLC, STAR TRANSPORTATION, LLC f/k/a STAR TRANSPORTATION, INC., STAR LOGISTICS SOLUTIONS, LLC f/k/a STAR TRANSPORTATION, LLC, COVENANT TRANSPORT, LLC and COVENANT TRANSPORT SOLUTIONS, LLC, and hauling a 2023 Hyundai trailer owned and/or leased by Cross-Defendant, STAR TRANSPORTATION PA INC, and/or Defendants, STAR TRANSPORTATION, LLC, STAR TRANSPORTATION, LLC f/k/a STAR TRANSPORTATION, INC., STAR LOGISTICS SOLUTIONS, LLC f/k/a STAR TRANSPORTATION, LLC, COVENANT TRANSPORT, LLC and/or COVENANT TRANSPORT SOLUTIONS, LLC, while in the course and scope of employment with Cross-Defendant, STAR TRANSPORTATION PA INC, and/or Defendants, STAR TRANSPORTATION, LLC, STAR TRANSPORTATION, LLC f/k/a STAR TRANSPORTATION, INC., STAR LOGISTICS SOLUTIONS, LLC f/k/a STAR TRANSPORTATION, LLC, COVENANT TRANSPORT, LLC and/or COVENANT TRANSPORT SOLUTIONS. LLC, traveling eastbound on Interstate Highway 20, in the inside lane, and following behind Cross-Plaintiff/plaintiff CRAVER, in Harrison County, Texas. Suddenly and without warning, Defendants, VIDAL CABRERA ARNALDO and/or ARNALDO VIDAL CABRERA, failed to control the speed of his vehicle and struck the rear of Cross-Plaintiff/Plaintiff CRAVER’s vehicle, knocking Cross-Plaintiff/Plaintiff CRAVER’S vehicle into Kadee Wilkins Clark’s vehicle, subjecting Cross-Plaintiff/Plaintiff CRAVER to tremendous force.
