CITATION BY PUBLICATION THE STATE OF TEXAS: Cause # 25-0775 MARGARET SMITH, INDIVIDUALLY, IN THE 71ST DISTRICT COURT AND AS PERSONAL REPRESENTATIVE OF THE ESTATES OF GERALD RYAN LOFTICE, DECEASED AND HAILEY LOFTICE, INDIVIDUALLY AND AS PERSONAL REPRESENTATIVE OF THE ESTATE OF GERALD RYAN LOFTICE, DECEASED VS OF REPUBLIC SERVICES, INC., A DELAWARE CORPORATION, REPUBLIC SERVICES, INC., A DELAWARE CORPORATION D/B/A REPUBLIC WASTE HARRISON COUNTY, TEXAS SERVICES GROUP OF TEXAS, INC., REPUBLIC WASTE SERVICES GROUP OF TEXAS, INC., REPUBLIC SERVICES, INC., A TEXAS CORPORATION, REPUBLIC WASTE SERVICES OF TEXAS, LTD., REPUBLIC WASTE SERVICES (RWS) LEASING CO., TO: LEVITICUS ANTWOINE JOHNSON GREETING: NOTICE TO DEFENDANT: “You have been sued. You may employ an attorney. If you or your attorney do not file a written answer with the clerk who issued this citation by 10:00 am on the Monday next following the expiration of 42 days after the date this citation was issued, a default judgment may be taken against you.” In addition to filing a written answer with the Clerk, you may be required to make initial disclosures to the other party of this suit. You are hereby commanded to appear by filing a written answer to the Plaintiffs’ Original Petition at or before 10:00 o’clock A.M. on the Monday next after the expiration of 42 days after the date of issuance of this citation the same being Monday, MARCH 2, 2026, before the Honorable 71ST District Court of Harrison County, at the Courthouse in said County in Marshall, Texas. Said Plaintiff’s Petition was filed in said court on the 25TH day of AUGUST, 2025 in the above entitled cause. A brief statement of the nature of this suit is as follows, to-wit: INJURY OR DAMAGE. At approximately 3:10 p.m. on September 25, 2023, Gerald Ryan Loftice, while in the course and scope of employment with Defendants, REPUBLIC SERVICES, INC., A DELAWARE CORPORATION, REPUBLIC SERVICES, INC., A DELAWARE CORPORATION d/b/a REPUBLIC WASTE SERVICES GROUP OF TEXAS, INC., REPUBLIC WASTE SERVICES GROUP OF TEXAS, INC., REPUBLIC SERVICES, INC., A TEXAS CORPORATION, REPUBLIC WASTE SERVICES OF TEXAS, LTD., REPUBLIC WASTE SERVICES (RWS) LEASING CO, REPUBLIC WASTE SERVICES LEASING CO, RWS LEASING CO., ALLIED WASTE SYSTEMS HOLDINGS, INC., ALLIED WASTE SYSTEMS, INC., and/or ALLIED WASTE SYSTEMS, INC. d/b/a REPUBLIC SERVICES (collectively the “Republic/Allied Defendants”), was traveling in a 2016 Mack Truck owned and/or leased by the Republic/Allied Defendants, which was being operated by Defendant, LEVITICUS ANTWOINE JOHNSON, while defendant, Leviticus Antwoine Johnson, was in the course and scope of employment with the Republic/Allied Defendants, westbound on Farm-to-Market Road 349, in Gregg County, Texas. Defendant, LEVITICUS ANTWOINE JOHNSON, stopped the truck he was operating, and Gerald Ryan Loftice, while in the course and scope of employment with the Republic/Allied Defendants, exited the truck, walked across Farm-to-Market Road 349, took hold of a trash can, and began walking back across farm-to-Market Road 349, towards the rear of the truck, with the trash can in-hand. Defendant, ROBERT NATHANIEL SMITH, II, was traveling in a 2016 Ford F150 pickup truck owned and/or leased by Defendant, ARLENE SMITH, westbound on Farm- to-Market Road 349, following behind the vehicle in which Gerald Ryan Loftice and Defendant, LEVITICUS ANTWOINE JOHNSON, were traveling, in Gregg County, Texas. Suddenly and without warning, Defendant, ROBERT NATHANIEL SMITH, II, as he was approaching Gerald Ryan Loftice and the truck being operated by Defendant, LEVITICUS ANTWOINE JOHNSON, failed to keep a proper lookout, failed to control the speed of his vehicle and struck Gerald Ryan Loftice, and the truck being operated by Defendant, LEVITICUS ANTWOINE JOHNSON, crushing Gerald Ryan Loftice between the two vehicles, subjecting Gerlad Ryan Loftice to tremendous force, and fatally injuring Gerald Ryan Loftice. Plaintiff, MARGARET SMITH, and Plaintiff, HAILEY LOFTICE are the Personal Representatives of the Estate of Gerald Ryan Loftice, Deceased. Plaintiff, MARGARET SMITH, is the surviving biological mother of Gerald Ryan Loftice, Deceased. Plaintiff, HAILEY LOFTICE, is the surviving biological child of Gerald Ryan Loftice, Deceased. Plaintiffs’ claims include all survival and wrongful death claims and causes of action, both at common law and pursuant to statute, including Chapter 71, Texas Civil Practice and Remedies Code.
