The State of Texas filed a Petition for Condemnation with the Judge of the County Court at Law No. ___ of Smith County, Texas, on the 9th day of July, 2025, in Cause No. 78568, which is styled The State of Texas v. The Heirs and Devisees of the Estate of Mary Brown Black, deceased, et al. This suit is an eminent domain proceeding in which the State of Texas is condemning a tract of land located in Smith County, Texas, containing a 0.2178 acre (9,488 square feet) parcel of land situated in the John J. Ratcliff Survey, Abstract No. 819, located in Smith County, Texas, and being out of and a part of a remainder of a called 8.3 acre tract of land (calculated 7.049 acres) described in the deed executed December 5, 1941 from Buela Brown Moore, Et Al. to Mary Brown Black, recorded in Volume 451, Page 588 of the Deed Records of Smith County, Texas (D.R.S.C.T.), such property being fully described in Exhibit “A” of Plaintiff’s Petition for Condemnation filed under the above-referenced cause number. The Plaintiff is the State of Texas. The name and address of the attorney for Plaintiff is Debora Pickens, Assistant Attorney General, P.O. Box 12548, Austin, Texas 78711-2548. The known Defendants in the case are: Glendell Davis; Cynthia Renee Bell, as an Individual and a Trustee for Darrel D. Dancer; Oscar Charles Bell; Dora Mae Bell; Naman Black, II; and Deborah Black. The unknown Defendants and unlocated parties of interest, including Defendants whose residence is unknown, whose whereabouts could not otherwise be located after due diligence, or such Defendants absent from or a nonresident of the State, whom the State of Texas has attempted to obtain personal service of nonresident notice as provided for in Rule 108, but have been unable to do so, are: The Heirs and Devisees of the Estate of Mary Brown Black, deceased, if any or all of the defendants, the unknown heirs and, if any of them are deceased, their respective heirs and legal representatives, if any. The interests of these unknown or unlocated Defendants are that they either own or may claim an interest in said property subject to the condemnation and may be entitled to a portion of the proceeds thereof, subject to unpaid accrued taxes. You are each hereby further notified that the undersigned special commissioners appointed to assess the damages in the above proceedings have met and set a time and place for the special commissioners’ hearing in said proceeding and find that the 14th day of November, 2025, is the earliest practicable date for a hearing of the parties; that the most convenient place in this County to hold the hearing is Smith County Courthouse in Auxiliary Courtroom located at 100 N. Broadway Avenue, Tyler, Texas 75702; and that the hearing shall commence at this location at 10:00 o’clock a.m. You are further notified that you may appear at the hearing before the special commissioners and present evidence on the issue of damages to be assessed against the State. If you do not appear at the hearing, the special commissioners shall proceed to assess the total compensation to be provided to the owners of the property being condemned and any other interested parties. Determinations regarding the proper allocation of funds and declarations of interest as to any amount will occur later at a separate hearing. If this Notice is not served within ninety (90) days after issuance, it shall be returned.
