Notice of Foreclosure Sale THE STATE OF TEXAS ) COUNTY OF PANOLA ) THIS NOTICE OF FORECLOSURE IS GIVEN pursuant to Tex. Tax Code Chapter 34, and Tex. R. Civ. P. 21a., by virtue of an Order of Sale issued on February 27, 2026, pursuant to the Judgment rendered in favor of the plaintiffs and/or intervenors on November 13, 2025 by the 123rd Judicial District Court in Panola County, Texas, in Cause No. 2023-028 styled FNA 2019-1, LLC vs. VERN W. BERGGREN, ET AL, on March 3, 2026, I levied, against all legal interest and/or right of all defendants subject to said Judgment, upon the following described tracts or parcels of land: STREET ADDRESS: 809 Banks, Carthage TX 75633; TAX ACCOUNT NUMBER(S): 9702; and LEGAL DESCRIPTION: BLK 75 LT 7 P-8; and being more particularly described as BEING Lot 7, Block 75, of the City of Carthage, Panola County, Texas, being situated in the Adolphus Moorman Survey, Abstract No. 427, according to the New City Plat of the City of Carthage recorded in Volume 3, Page 396, Plat Records of Panola County, Texas; said tract of land being same tract of land described in deed from J. Lloyd Woods to Johnnie Hall, dated September 22, 2000, and recorded in Volume 1102, Page 759, Official Public Records, Panola County, Texas, and being further described by metes and bounds as follows, to-wit: All that certain lot of parcel of land situated about one mile West of Carthage, in Panola County, Texas, a part of the Adolphus Moorman Survey, and being further described as follows: BEGINNING at the N.W. corner of a Lot heretofore conveyed by W.R. Banks and Mrs. Carrie Phillips to T.M. Hayes, an iron stake on Banks N.B. line; THENCE S. 80 W. with W.R. Banks North line 210 feet to a stake; THENCE S. 10 E. 105 feet to a stake; THENCE N. 80 E. 200 feet to a stake; THENCE N. 10 W. 5 feet to a stake; THENCE N. 80 E. 10 feet to the W.B. Line of Lot heretofore conveyed by W.R. Banks and Mrs. Carrie Phillips to T.M. Hayes; THENCE N. 10 W. 100 feet to the place of BEGINNING, -SAVE AND EXCEPT HOWEVER, a tract 70 feet in width by 105 feet in length off the West side of the above described tract heretofore conveyed by A.A. Humphries and wife, Clara, to T.C. Pass, by deed recorded in Vol. 248, Page 606 of the Deed Records of Panola County, Texas, here referred to for further description of said lot conveyed to the said T.C. Pass. On May 5, 2026, being the first Tuesday of said month, between the hours of 10:00 am and 4:00 pm, at the steps on East side of Courthouse, Carthage, Texas, I will offer for sale and sell at public auction, for cash, all the right, title, and interest of all defendants subject to said Judgment, in and to said tracts or parcels of land, as provided for by the Texas Tax Code, to satisfy said Judgment for delinquent property taxes, accrued penalties, interests, and attorney’s fees, totaling $40,090.13, plus all post judgment interest, penalties, court costs and costs of sale awarded therein and pursuant to the Texas Tax Code, due on said tracts or parcels of land. The sale shall begin no earlier than 10:00 a.m. and no later than three hours thereafter. The sale shall be completed by three hours after it commences or 4:00 p.m., whichever occurs first. I hereby verify, certify and declare under penalty of perjury that I delivered a true and correct copy of this Notice of Foreclosure Sale by Certified Mail and First-Class Mail through the United States Postal Service, return receipt requested, to each of the defendant named in said Judgment. “THIS SALE IS BEING CONDUCTED PURSUANT TO STATUTORY OR JUDICIAL REQUIREMENTS. BIDDERS WILL BID ON THE RIGHTS, TITLE, AND INTERESTS, IF ANY, IN THE REAL PROPERTY OFFERED. “THE PROPERTY IS SOLD AS IS, WHERE IS, AND WITHOUT ANY WARRANTY, EITHER EXPRESS OR IMPLIED. NEITHER THE SELLER NOR THE SHERIFF’S DEPARTMENT WARRANTS OR MAKES ANY REPRESENTATIONS ABOUT THE PROPERTY’S TITLE, CONDITION, HABITABILITY, MERCHANTABILITY, OR FITNESS FOR A PARTICULAR PURPOSE.
