FINDINGS OF FACT NOTICE

CITY OF LONGVIEW § IN THE MUNICIPAL COURT V. § CITY OF LONGVIEW § STATE OF TEXAS BONIFACIO RAMOS RAFEL LUNA REYES NATHANIEL CARTER DARIUS WOODSON ANDRES GARCIA RICHARD POSEY VERNON STUMBLINGBEAR DANIEL PRESSON WILL JACKSON ORDER WITH FINDINGS OF FACT I. On February 17, 2026, a public hearing (the Hearing) was conducted before this Court regarding the status of property located at 2738 & 2742 ESTES PKWY, AB 2 A R JOHNSON SUR TR 8 SEC 4, IN REM; 1111 CLOVER LN, LT 12 (S 50’ LT 12) BLK 5 (NCB 265) BUCHANAN GARDENS, IN REM; 601 LEVEL ST, LT 10 (S 172’ LT 10) BLK 1 (NCB 262) BUCHANAN GARDENS, IN REM; 1209 WELLS ST, LT 23 BLK 683 LATHAM DOWNS, IN REM; 555 MOBBERLY AV, LT 10 NCB 176 LONGVIEW GREER ACREAGE, IN REM; BRENT RD. 1579585, LT 6 BLK 1 L H SIMMONS SUBDIVISION, IN REM; 610 BUCHANAN AV, LTS 6A & 7 (E 25’ LT 6) BLK 7 (NCB 255) IDYLWOOD, IN REM; 206 JEWEL DR, LTS 4A & 5 BLK 7 (NCB 452) WARE PLACE (W 6’ LT 4), IN REM; 626 FOURTEENTH ST, LT 3C-1 BLK 368 SOUTHSIDE GARDENS, IN REM; Longview, Gregg County, Texas (the Property). At the Hearing, the City of Longview (the City), acting by and through the Office of the City Attorney, requested that the building or structure located on the Property be declared a dangerous building or structure, a public nuisance, and a threat to the public health, safety and welfare in accordance with Article III, Chapter 19 of the Code of Ordinances of the City of Longview and Chapters 54 and 214 of the Texas Local Government Code. In accordance with said authority, the City also sought an appropriat Court Order to demolish or repair the aforesaid building or structure. Based on the evidence presented at the Hearing, this Court makes the following findings of fact with regard to the Property: 1. The owner(s) of the Property, to wit: BONIFACIO RAMOS, RAFEL LUNA REYES, ARMANDO & MARIA DE JESUS OLIVAN, NATHANIEL CARTER, DARIUS WOODSON, ANDRES GARCIA, RICHARD POSEY, VERNON STUMBLINGBEAR, DANIEL PRESSON, WILL JACKSON were given notice of the Hearing in accordance with the requirements of Article III, Chapter 19 of the Code of Ordinances of the City of Longview and Chapters 54 and 214 of the Texas Local Government Code. 2. The following owner(s) appeared at the Hearing: WILL JACKSON, BONIFACIOS RAMOS, NATHANIEL CARTER, RICHARD POSEY. 3. The holder(s) of any recorded mortgages or liens against the Property, to wit: NIA were given notice of the Hearing in accordance with the requirements of Article III, Chapter 19 of the Code of Ordinances of the City of Longview and Chapters 54 and 214 of the Texas Local Government Code. 4. The following recorded mortgagee or lienholder appeared at the Hearing: NONE. 5. At the Hearing, evidence was presented by the Office of the City Attorney, in part consisting of written documentation, a copy of which is appended to these findings of fact and incorporated herein for all purposes. 6. At the Hearing, the following person(s) appeared and presented testimony: DAMIEN REESE, WILL JACKSON, BONIFACIOS RAMOS, NATHANIEL CARTER, RICHARD POSEY. 7. The buildings or structures located on the Property are substandard and in violation of Article III, Chapter 19 of the Code of Ordinances of the City of Longview for the following reasons: VACANT SUBSTANDARD STRUCTURE, DANGEROUS BUILDING, DAMAGED WINDOWS, DAMAGED WALLS, DAMAGED CEILING, DAMAGED SIDING, DAMAGED ROOFING, DAMAGED FLOORING ETC. INCLUDING ACCESSORY STRUCTURE(S) 8. Based on the evidence presented at the Hearing and on the findings of this Court, the building or structure located on the Property is a dangerous and substandard building or structure, a public nuisance, and a threat to the public health, safety and welfare in accordance with Article III, Chapter 19 of the Code of Ordinances of the City of Longview and Chapters 54 and 214 of the Texas Local Government Code. II. It is therefore ORDERED, ADJUDGED AN DECREED by the Court that the building or structure located on the Property is a dangerous building or structure, a public nuisance and a threat to the public health, safety and welfare in accordance with Article III, Chapter 19 of the Code of Ordinances of the City of Longview and Chapters 54 and 214 of the Texas Local Government Code and that, AS LISTED ABOVE, the owners of the Property, are commanded to make the following repairs: as listed in number 7 above and any and all building, mechanical, plumbing, structural and electrical repairs necessary to eliminate code of ordinance violations in and on said property, It is specifically ordered that. The Respondent, AS LISTED ABOVE, shall make all repairs necessary to bring the structure into conformity and compliance with the requirements of existing code, statute and ordinance, within 30 or 60 days of the date of this hearing - or - continuance of case till next hearing on or; and The Respondent, shall complete all other repairs upon the structure, including electrical, mechanical and plumbing repairs, to bring the structure into complete compliance with the requirements of existing code, statute and ordinance, within 30 or 60 days of this hearing - or - continuance of the case until the next docket scheduled for or ; and The cases against N/A were dismissed due to the violative conditions on their properties being eliminated; and The Respondent, shall secure the property and structure within thirty days of this hearing, And The Respondent shall return to this Court for any subsequent hearing, as requested by the City of Longview and ordered by this Court, Should said owners, mortgages or lienholders fail to complete repairs as ordered, said owner of the property, is commanded to demolish said building or structure and to remove it so that it in no manner violates the aforesaid ordinance and statutes within 30 or 60 days from the date of this Order, and that, if said owner fails to comply with this Order within said 30 or 60 days of the order to demolish said building or structure, then any recorded lienholder(s) and/or mortgagee(s) of record, shall have an additional sixty (60) days to demolish said building or structure and to remove it so that it in no manner violates the aforesaid ordinance and statutes.
