CITATION BY PUBLICATION THE STATE OF TEXAS CAUSE # 26-0539 MARSHALL MINE LLC IN THE 71ST DISTRICT COURT VS OF W.V. THOMPSON HEIRS ET AL HARRISON COUNTY, TEXAS AND THEIR UNKNOWN HEIRS TO: W. V. THOMPSON, LESSIE THOMPSON, CHARLES SMITH, GEORGIA SMITH, ARTHOR (AKA ARTHUR) WILLIAMS, MAYBELLE WILLIAMS AND CHARLES WILLIAMS, AND THEIR UNKNOWN HEIRS AND ASSIGNS GREETING: NOTICE TO DEFENDANT: “You have been sued. You may employ an attorney. If you or your attorney do not file a written answer with the clerk who issued this citation by 10:00 am on the Monday next following the expiration of 42 days after the date this citation was issued, a default judgment may be taken against you.” You are hereby commanded to appear by filing a written answer to the Plaintiff’s Original Petition at or before 10:00 o’clock A.M. on the Monday next after the expiration of 42 days after the date of issuance of this citation the same being Monday, AUGUST 24, 2026, before the Honorable 71ST District Court of Harrison County, at the Courthouse in said County in Marshall, Texas. Said Plaintiff’s Petition was filed in said court on the 26TH day of JUNE, 2026 in the above entitled cause. A brief statement of the nature of this suit is as follows, to-wit: PLAINTIFF’S ORIGINAL PETITION, TRESPASS TO TRY TITLE. TRACT 17: 23.65 acres of land, more or less, situated in the E. Marlowe Survey, A-487, Harrison County, Texas, and more particularly described as Block 1 in a Partition Deed dated January 21, 1928, from W.V. Thompson et al to W.V. Thompson, recorded in Volume 158, Page 39, Deed Records, Harrison County, Texas described as follows: BEGINNING at the North West corner of said Marlowe Survey a pine knot brs S 50 W 6-6/10 vrs and a sweet gum brs N 61-1/4 E 1-9/10 vrs both marked X; THENCE South 422 vrs to rock for corner on the West boundary line of said Marlowe Survey; THENCE East 328 vrs to the South West corner of Block No. 2 set aside to Eddie Murphy et al; THENCE North 392 vrs to corner on the North boundary line of said Marlowe Survey; THENCE N 84-3/4 W 329 vrs to the place of beginning. TRACT 9 & 10A: 24.00 acres plus 1 acre of land, more or less, located in the E. Marlowe Survey, A- 1022, Panola County, Texas, and A-487, Harrison County, Texas, and more particularly described as Block 5 in a Partition Deed dated January 21, 1928, from W.V. Thompson et al to Arthor Williams, recorded in Volume 158, Page 39, Deed Records, Harrison County, Texas. (TRACT 9) Block No. 5 containing 24 acres plus 1 acre set aside to Arthur Williams. First Tract: BEGINNING at the northeast corner of Block No. 4; THENCE South 446 vrs to the southeast corner of Block No. 4; Copy from re:SearchTX THENCE East 256 vrs to the north northeast corner of Block No. 6, a red oak marked “X” for corner; THENCE N 30 East 320 vrs to the southeast corner of Block No. 3; THENCE North 173 vrs to corner; THENCE West 406 vrs to the place of beginning, containing 24 acres Also, one acre described as follows: (TRACT 10A) BEGINNING at the N.E. corner of said Marlowe Survey, a gun barrel for corner; THENCE West 100 vrs to the northeast corner of Block No. 3; THENCE South 173 vrs to the most eastern S.E. corner of Block No. 3; THENCE North 30 East 200 vrs to the place of beginning.
